1. Definitions
In these Terms and Conditions, the following terms have the following meanings:
- "Silk Path" refers to the residential home and associated services operated at 39 Kwun Tong Road, Kwun Tong, Kowloon, Hong Kong.
- "Service" refers to any of the residential, workshop, or trial stay offerings provided by Silk Path.
- "User" refers to any person who accesses the Silk Path website or enquires about services.
- "Resident" refers to an elder who has entered into a residential agreement with Silk Path.
- "Family" refers to the family members or authorised representatives of a Resident or prospective Resident.
- "Agreement" refers to these Terms and Conditions together with any service-specific documentation provided at the time of enrolment.
2. Acceptance of Terms
By using the Silk Path website or enquiring about services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or proceed with an enquiry.
Residential and workshop services are available to individuals aged 18 and over. By submitting an enquiry on behalf of an elder, you confirm that you have the authority to do so.
3. Service Description
Silk Path provides the following services:
- Woven Living Residence: Full-time residential accommodation for elders, including meals, housekeeping, laundry, and participation in weekly activities. Available at HK$13,400 per month.
- Textile and Craft Workshops: A twice-weekly afternoon activity programme open to residents and non-residents. Available at HK$1,600 per month.
- Fortnight Familiarisation Stay: A two-week residential trial stay with full access to meals and activities, and a written family summary at the end. Available at HK$7,800 for two weeks.
Silk Path is a residential home and does not provide medical, nursing, or clinical care. Services are intended for elders who are generally independent in their daily lives.
Service availability is subject to room and programme availability at the time of enquiry.
4. Enquiries and Agreements
Submitting an enquiry through our website or by telephone does not constitute a binding agreement. A service agreement is formed only when Silk Path has confirmed availability and both parties have agreed to the terms of the specific service, including fee arrangements.
Silk Path reserves the right to decline an enquiry or application where the elder's needs fall outside the scope of services we provide.
5. User Responsibilities
When using our website and services, users agree to:
- Provide accurate and complete information when making enquiries or arranging services
- Notify Silk Path promptly of any changes to the elder's health or care needs that may affect their suitability for non-medical residential care
- Use the website only for lawful purposes
- Treat staff and residents with respect during visits and communications
6. Prohibited Activities
Users must not:
- Misrepresent the needs or circumstances of the elder when making enquiries
- Interfere with the comfort or daily routine of other residents during visits
- Record, photograph, or share images or information about other residents without their consent
- Attempt to access areas of the Silk Path premises not open to visitors
7. Intellectual Property
All content on the Silk Path website, including text, images, and design, is the property of Silk Path. You may not reproduce, distribute, or use this content for commercial purposes without our written permission. Limited personal use is permitted.
8. Payment Terms
All fees are quoted and payable in Hong Kong Dollars (HKD). Full details of payment schedules and methods will be provided at the time of agreeing to a service. Unless otherwise agreed in writing:
- Residential fees are payable monthly in advance
- Workshop fees are payable monthly
- Trial stay fees are payable in full before the stay begins
9. Cancellation and Withdrawal
Residential Services
Notice requirements and any applicable terms for ending a residential arrangement will be set out in the individual service agreement provided at the time of move-in.
Workshop Programme
The workshop programme may be discontinued with one month's written notice. Fees paid for an active month are non-refundable except where Silk Path cancels a session.
Trial Stay
Cancellations of a Fortnight Familiarisation Stay made with more than 7 days' notice may receive a partial refund at Silk Path's discretion. Cancellations made within 7 days of the start date are non-refundable.
10. Disclaimers
Silk Path provides residential and social care services to elders. It does not provide medical, nursing, clinical, or therapeutic services. Nothing on the Silk Path website constitutes medical advice.
While we take care in the design and delivery of our services, we cannot and do not make any assurances about specific outcomes for residents or workshop participants.
Our website and online information are provided in good faith. We do not warrant that content is free from errors or that the website will be available without interruption.
11. Limitation of Liability
To the extent permitted by Hong Kong law, Silk Path's total liability to you in connection with the use of our website or services is limited to the fees paid for the specific service in question in the preceding three months.
We are not liable for indirect, incidental, or consequential losses arising from the use of our website or services.
12. Indemnification
You agree to indemnify Silk Path against any claims, losses, or expenses arising from your breach of these Terms, your misuse of our website or services, or any information you provided that was inaccurate or misleading.
13. Termination
Silk Path may terminate or suspend access to services if a user or family member acts in breach of these Terms, if the elder's care needs fall outside the scope of non-medical residential care, or if continued provision of service is no longer practicable. In such circumstances, we will provide reasonable notice wherever possible.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms or our services will first be addressed through informal resolution between the parties. If informal resolution is not achievable, disputes shall be subject to the jurisdiction of the courts of Hong Kong.
15. Changes to These Terms
We may revise these Terms from time to time. For existing service arrangements, material changes will be communicated with reasonable advance notice. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
